Terms of service
The service
Spark provides attendance, enrichment and exams administration for UK colleges: a web console, iOS apps for staff and families, statutory attendance registers, exam identity checks, reporting, and a tamper-evident audit trail. Each college’s data is held in its own separate database in the UK; data protection roles and commitments are set out in the data processing terms and privacy notice.
Beta programme
Spark is currently offered as a beta. Features may change, and while we operate backups, monitoring and the security measures described in the DPA, the service is provided without uptime guarantees during the beta period. We will give colleges reasonable notice of material changes and of the end of the beta.
Accounts and acceptable use
- Access is provisioned by each college for its own staff, students and families. Keep credentials confidential and tell us or your college promptly about any suspected compromise.
- Use Spark only for the college’s legitimate educational administration. Do not attempt to access another college’s tenant, probe or overload the service, or reverse engineer it except as law permits.
- The college is responsible for the accuracy of the data it enters and for having a lawful basis for it; we process it as described in the DPA.
Intellectual property
We own the Spark software and branding. The college owns its data; we claim no rights over it beyond what is needed to run the service, and we do not use college data to train AI models.
Suspension and termination
We may suspend access that presents a security risk or materially breaches these terms, restoring it as soon as the issue is resolved. On termination, data return and deletion follow the DPA.
Liability
Nothing in these terms excludes liability that cannot be excluded by law. Otherwise, our aggregate liability is capped as set out in the college’s service agreement, and we are not liable for indirect or consequential loss.
General
These terms are governed by the law of England and Wales, with the courts of England and Wales having exclusive jurisdiction. If any provision is unenforceable, the rest remain in force. Questions: hello@velocity-eu.com.
